Terms & Conditions

GENERAL TERMS AND CONDITIONS

twifi by Travelers Wifi – amenity GmbH

Part A – General Terms and Conditions

1. Scope of Application

These General Terms and Conditions (hereinafter referred to as “GTC”) apply to all services and products (hereinafter jointly referred to as “Services”) provided by amenity GmbH under the “twifi” brand to the Customer. The nature and scope of the contractual services are further defined by the provisions of the respective contracts and the current service descriptions in brochures or on the twifi website https://www.twifi.ch.

Insofar as these GTC contain specific provisions for fibre-optic connections (hereinafter “Fibre”), these provisions shall apply in addition to the general provisions and shall take precedence over the general provisions in the event of any conflict.

2. Services, Prices

The tariffs and other service descriptions applicable to the individual products and services and published on the twifi website at the time the contract is concluded shall apply.

3. Twifi’s Obligations

Twifi provides the Customer with a mobile telecommunications connection from Sunrise and Salt. Through this mobile telecommunications connection, the Customer may use the Sunrise and Salt mobile networks within Switzerland by means of a mobile device to establish data connections.

Data usage is unlimited subject to Section 15 (Misuse). Salt reduces the speed to 256 kbps after 500 GB per month.

Twifi is free to choose the technical means used to provide the agreed Services, unless otherwise contractually agreed. Such technical means include, for example, infrastructure, platforms, transmission technologies and protocols, as well as user interfaces.

Twifi shall be released from its obligation to perform in cases of force majeure. Force majeure includes all unforeseeable events and events whose consequences for the performance of the contract cannot be attributed to either party.

4. Customer’s Obligations

The Customer is obliged to use Twifi’s Services in accordance with the contract and to pay for the Services obtained on time.

Upon registration, the Customer must prove their identity using an official identification document, keep Twifi informed at all times of their current name and address details, and notify Twifi immediately of any changes online or in writing. Twifi is entitled to withhold the contractually owed Services until the Customer has provided correct and complete information and verified their identity. The Customer’s obligation to pay for the Services remains unaffected.

The Customer must follow all security instructions recommended by Twifi, in particular protect devices against unauthorised access by third parties, regularly back up data to prevent data loss, and carefully safeguard access data, passwords and PIN numbers and not disclose them to third parties.

In the event of loss of access data, passwords, PIN numbers, a router or a SIM card, Twifi must be notified immediately. Until Twifi is notified, the Customer remains responsible in all cases (e.g. use by third parties) for payment of Services obtained through the respective connection.

5. Warranty for Services

Twifi undertakes to provide the Customer with the contractually agreed Services with due care. The Services are intended for normal private or business use.

Twifi endeavours to ensure a high quality of its Services and networks. Network disruptions within Twifi’s area of responsibility shall be remedied as quickly as possible.

The network coverage indicated by Twifi is non-binding. Twifi does not guarantee:

  • continuous and uninterrupted operation of its Services;
  • comprehensive network coverage;
  • specific transmission times or capacities;
  • the integrity of data transmitted or obtained via Twifi’s infrastructure or third-party networks;
  • content and services created or made available by third parties;
  • absolute protection of its network or third-party networks against unauthorised access or interception;
  • protection against malicious software, viruses, spam, Trojans, phishing attacks and other criminal activities by third parties;
  • prevention of data loss resulting from network disruptions or the repair of devices;
  • security measures on Twifi’s infrastructure that prevent damage to the Customer’s devices.

With regard to data traffic via the Sunrise or Salt mobile networks, Twifi does not guarantee minimum availability. The stated network bandwidths and transmission speeds represent best-effort performance and cannot be guaranteed. Actual Internet speed depends, for example, on network coverage, network utilisation, network quality and network expansion, as well as other factors, and may be lower than the stated maximum values.

Twifi reserves the right to carry out maintenance work on the network that may result in interruptions or reductions in service.

The occurrence of any of the aforementioned events does not constitute an important reason for extraordinary termination by the Customer within the meaning of Section 22.

6. Options, Accessories

Options for mobile telecommunications services include additional functions or benefits and are either offered free of charge or charged by means of a subscription fee or usage-based fees. The availability of individual options depending on the subscription, their scope of services and contract duration are stated on the twifi website and in the twifi service descriptions.

Twifi does not guarantee the continuous availability of options. Twifi reserves the right to expand, restrict, discontinue or otherwise modify options at any time. If the Customer has subscribed to such an option, such changes shall be communicated in an appropriate manner in advance; Section 24 applies. Restriction or discontinuation of an option does not affect the underlying contract.

7. Telephone Number, SIM Card

There is no entitlement to retain an assigned telephone number or transfer it to third parties. If required for legal, regulatory, operational or technical reasons, Twifi may withdraw or change assigned telephone numbers. There is no entitlement to compensation. After termination of the contract, the telephone number reverts to Twifi.

Replacement SIM cards or switching to another card format are generally subject to a fee.

8. General Tariff Details

The prices and conditions published at the time the contract is concluded shall apply. Only services for which billing data is available shall be included in the invoice. Charges relating to data supplied at a later date, such as roaming charges, may appear on subsequent invoices.

Unless otherwise stipulated in the mobile telecommunications contract or service descriptions, the following provisions apply:

  • For flat-rate subscriptions, the following are charged in addition to the basic fee: connections abroad, connections within and from abroad, connections to special numbers (e.g. 084x, 090x, 18xx), connections to premium-rate services and fees for options. Such services are only included in flat rates if expressly stated in the relevant tariff.
  • Calls are generally billed in one-minute increments; mobile Internet connections abroad are billed in 20 KB increments.
  • SMS/MMS flat rates apply only to SMS/MMS sent within Switzerland.
  • Calls from Switzerland to certain premium-rate or special numbers abroad are not included in flat rates and are charged separately.
  • Data allowances, included credits or a specified capacity not used during a particular period expire and are not carried over to the following period.
  • For mobile Internet connections, data volumes included in the price plan apply only to use in Switzerland. Mobile Internet connections abroad are charged according to the roaming tariffs of the foreign provider.

9. Devices (Rental Devices)

The Customer is responsible for ensuring that their device is functional and compatible with Twifi’s infrastructure.

In the event of a device defect, customers may claim the manufacturer’s 24-month warranty for devices rented from Twifi. The warranty claim is subject to the conditions of the respective manufacturer. Subject to the repair warranty set out below, Twifi provides no further warranties.

The Customer is obliged to inspect the rental device immediately upon receipt and report any defects immediately. If a defect has been reported immediately by the Customer, Twifi or the manufacturer shall have the right to choose whether to repair the device or replace it with an equivalent device. Rescission of the contract is excluded. The Customer is responsible for backing up any data stored on the device; liability for lost data is excluded. Repaired or replaced devices are covered by a three-month warranty if the original warranty period is not longer and the manufacturer’s warranty does not provide for a different warranty period. The warranty does not cover normal wear and tear, improper handling, defects caused by external influences (force, dropping, water, moisture, heat, cold, malware, viruses, etc.) or incompatibility with technical infrastructures. Any intervention by the Customer in the device shall invalidate the right to repair or replacement.

The Customer is obliged to return rental equipment received free of charge during the contract period after termination of the contractual relationship, at the latest by the return date specified in the termination confirmation, to Twifi. If no date is specified in the termination confirmation, the return must be made within 10 working days after termination of the contractual relationship. The router and accessories must be returned by registered mail using the enclosed box and address label to the following address:

twifi c/o amenity GmbH, Bahnhofstrasse 17, 5000 Aarau

If the device is not returned on time (the postmark is decisive), it shall be deemed not to have been returned and the following replacement prices shall be invoiced:

  • Home Internet Basic 4G: CHF 150
  • Home Internet Premium 4G+: CHF 200
  • Home Internet Ultimate 5G: CHF 300
  • Hotspot Basic 4G: CHF 150
  • Hotspot Premium 4G+: CHF 150
  • Hotspot Ultimate 5G: CHF 300

If individual accessories are missing from the return shipment, the following replacement prices shall be charged:

  • Power supply/charger: CHF 30.00
  • Fibre-optic cable (for fibre-optic connections only): CHF 10.00

The return of fibre-optic devices and accessories after termination of the contract shall be governed mutatis mutandis by this Section 9 and Section 10.

10. Damage, Contamination or Loss of Rental Devices

The Customer is obliged to handle rental devices provided by Twifi, including routers, hotspots and their accessories, carefully and in accordance with their intended purpose and to protect them against damage, loss and theft during the contractual period.

The Customer shall be liable for damage to rental devices caused by improper handling, negligence or external influences attributable to the Customer. This includes, in particular, damage caused by dropping, force, water, liquids, moisture, heat, cold or other improper handling.

The Customer shall also be liable for contamination or discolouration exceeding normal signs of use if the device can no longer be cleaned with reasonable effort or restored to a condition that permits contractual use, in particular transfer to another customer.

In such cases, Twifi is entitled to charge the Customer the necessary and reasonable costs for cleaning, refurbishment, repair or replacement of the rental device required to restore the device to its contractual condition. If repair or cleaning is not economically reasonable or possible, Twifi may charge the costs of replacing the rental device. Upon full payment of the replacement price, ownership of the affected device shall pass to the Customer. Twifi shall document the condition of the device before charging the costs (e.g. by means of photographs) and inform the Customer.

In the event of complete damage, loss or theft of the rental device, the replacement prices listed in Section 9 shall apply, insofar as they correspond to the relevant device type. Rental payments already made shall not be credited against the replacement price.

Normal wear and tear resulting from proper use, as well as ordinary signs of use, shall not constitute damage for which the Customer is liable.

The assertion of further demonstrable damages remains reserved to the extent permitted by law.

11. Third-Party Services

If a service or additional service originates from a third-party provider (e.g. premium-rate services), the Customer enters into a contract with that third party unless otherwise agreed, and the third party’s contractual terms and conditions shall apply. Twifi’s service is limited to providing technical access to the other provider. Depending on the service, Twifi may collect the fees on behalf of the provider and handle the collection process. The Customer may have access to all telephone premium-rate services for which Twifi handles collection blocked, or only access to certain (erotic) premium-rate services, provided Twifi offers selective blocking.

Twifi assumes no liability or warranty for such providers or their services.

12. Payment Terms

The following payment methods are available: credit card (via Stripe Payment) or bank transfer.

The first subscription invoice is paid in advance, either by credit card or bank transfer. Subsequent invoices are issued monthly from the delivery date.

If the Customer has chosen payment by credit card, the credit card provided by the Customer will be charged automatically each month with the agreed amount. If the stored credit card cannot be charged, the Customer will receive an invoice by email. If the Customer has chosen payment by bank transfer, the Customer will receive the invoice monthly by email.

Invoices are prepared on the basis of technical records. For minor invoice amounts, Twifi is entitled to postpone invoicing. A small fee will be charged for invoices sent by post. The Customer undertakes to pay the invoiced amount by the due date stated on the invoice. If no due date is stated, a payment period of 30 days shall apply.

Amounts owed for the use of premium-rate services or the purchase of services from other third-party providers may be charged to the Customer together with Twifi’s own invoice. The provisions on payment and default (Sections 12–13) also apply if Twifi handles collection for third parties; the exception is disputed invoices for premium-rate services where the connection is blocked or the contract terminated as a result of the dispute before the dispute has been resolved.

Objections to an invoice must be submitted to the issuer of the invoice with reasons within 30 days. Otherwise, the invoice shall be deemed accepted by the Customer.

Refund claims by the Customer relating to overpaid amounts shall be credited to the Customer’s account and deducted from the following invoice. Upon termination of the contract, all outstanding claims become due.

Fibre billing:
Fibre is billed according to the calendar month (from the first to the last day of the respective calendar month), regardless of the Customer’s individual invoice date.

If an existing Customer switches to Fibre, billing will change to the calendar month upon the switch. Periods already paid in advance or still outstanding will be charged or credited on a pro-rata basis once during the transition.

If activation takes place during a calendar month, the basic fee for the first month will be charged on a pro-rata basis. From the following month onwards, the full calendar month will be invoiced.

13. Default

If the Customer fails to fulfil their payment obligation within the payment period or waives a justified objection, the Customer shall be in default upon expiry of the payment period without further notice and shall pay default interest of 5%. Default shall also occur if part of an invoice is disputed and the undisputed part is not paid or if Twifi has rejected the Customer’s objection as unfounded. Pursuant to Section 16 (Blocking) or Section 22 (Termination for Important Reason), Twifi may then block the Services and terminate the contract. Twifi is entitled to charge CHF 30 in reminder fees per reminder. The Customer shall compensate Twifi for all costs incurred by Twifi as a result of the payment default, including collection costs.

The outstanding invoice amount (including default interest and reminder fees) may be assigned or sold for the purpose of collection. In addition to payment of the invoice amount, the Customer shall also be liable for all costs arising from the payment default.

14. Data Protection

Twifi processes personal data in connection with the provision of its Services in compliance with applicable data protection legislation, in particular the revised Swiss Data Protection Act (FADP). Details concerning the type, scope, purpose, retention and disclosure of processed personal data and the rights of data subjects (in particular access, correction, deletion and data portability) are set out in Twifi’s separate Privacy Policy, available at https://www.twifi.ch.

Twifi may collect personal data itself, obtain it from third parties, store and process it and, where necessary and legally permissible, disclose it to third parties, in particular for the following purposes:

  • checking the requirements for concluding a contract;
  • fulfilment of contractual obligations towards the Customer;
  • maintenance and development of the customer relationship within the amenity Group;
  • address validation;
  • prevention of unlawful or abusive use of Services (in particular fraud prevention when concluding a contract and during the contractual period);
  • invoicing and collection;
  • creditworthiness and credit checks;
  • promotion, design and further development of Twifi products;
  • publication in directories (e.g. subscriber directories), provided that the Customer consents.

If the Customer obtains third-party services via Twifi’s network, Twifi may provide the third party with the Customer data required for the provision of the service to the same extent for the third party’s own processing. The Customer further consents to data being provided to third parties and processed by third parties for the purpose of creating files relating to creditworthiness and credit ratings, address validation and data relating to indications of unlawful use of Services. Personal data shall only be disclosed abroad in compliance with the statutory requirements.

Twifi may restrict the statutory right of access to the extent permitted by law. Excluded from access are so-called communication metadata generated through Services subscribed to by the Customer and subject to telecommunications secrecy, unless such data serves as the basis for invoicing.

15. Misuse

Services may not be used improperly, i.e. in a manner contrary to the contract or the law. Misuse includes, in particular:

  • use of the Services for purposes other than those intended;
  • resale of Services by the Customer or third parties;
  • use of Services to terminate calls on Twifi’s mobile network using GSM gateways or similar equipment;
  • establishing permanent connections or connections that result directly or indirectly in payments or other consideration from third parties to the Customer;
  • forwarding connections to short-code or premium-rate numbers;
  • distribution of mass advertising or malicious software;
  • connection of incompatible devices to Twifi’s infrastructure;
  • unauthorised access to or use of data, systems and network elements;
  • excessive use that may result in system or network overload or impair network availability for other participants.

Resale of Services to third parties is only permitted with Twifi’s prior written consent. Third parties within the meaning of this provision also include companies affiliated with the Customer.

In the event of excessive use, Twifi may take reasonable traffic management measures to ensure stable network availability.

The Customer shall indemnify Twifi against third-party claims arising from misuse of the Services by the Customer. Twifi must be notified immediately in the event of misuse to the detriment of the Customer.

16. Blocking

Twifi may block Services, in whole or in part, without prior notice or restrict them to certain Services if (i) an important reason within the meaning of Section 22 exists, (ii) blocking is presumed to be in the Customer’s interest, e.g. in the event of misuse by third parties, or (iii) there are justified doubts regarding compliance with payment obligations, until a deposit has been provided.

The Customer shall be informed of the blocking by appropriate means. Blocking may be maintained until the reason for the blocking ceases to exist.

If the Customer is responsible for the reason for the blocking, their obligation to pay for the Service remains unaffected during the blocking period and they may be charged CHF 50 for the blocking as well as any costs for a replacement SIM card.

17. Liability

Twifi shall not be liable for force majeure or damage that Twifi is not responsible for or that has arisen as a result of the blocking or termination of Services. Liability for direct or indirect damages or consequential damages, as well as loss of profits and data, is excluded to the extent permitted by law.

18. Subscription Changes

Before expiry of the minimum contract term or contractual term, switching to a subscription with a lower basic fee is only possible against reasonable compensation (Section 23). Switching to a subscription with a higher basic fee is possible free of charge at any time.

19. Contract Duration

The contract shall enter into force on the date of the Customer’s signature, subject to a positive creditworthiness check or provision of the agreed deposit, unless a later date is specified in the contract. In the case of an order placed online, the contract shall commence when the Customer receives the corresponding contract confirmation from Twifi in writing or by email. At the latest, the contract shall commence upon activation or use of the relevant Service. Irrespective of the commencement of the contract, any minimum contract term shall always begin upon activation of the Service.

20. Termination of Mobile Telecommunications Contracts and Fibre Connections

Cancellations may be submitted by email to info@twifi.ch. If the Customer receives several Services, the Customer must specify exactly which Service is to be cancelled. A minimum contract term is determined by the individual contract. Contracts with a minimum contract term may be terminated with a notice period of 60 days at the earliest on the expiry date of the minimum contract term. After expiry of the minimum contract term, the contract may be terminated with 60 days’ notice at any time. Contracts without a minimum contract term may be terminated at any time with a notice period of two monthly billing periods. If a Service is discontinued, Twifi has the right to terminate contracts regardless of any minimum contract term with two months’ notice effective at the end of a billing period.

Termination and End of Service for Fibre:
In deviation from the above provisions, Fibre may only be terminated with a notice period of two months, effective at the end of a calendar month. The date on which the termination notice is received by Twifi is decisive for compliance with the notice period.

For technical and contractual reasons, the Fibre connection is deactivated exclusively at the end of a calendar month. The Service and the obligation to pay the basic fee therefore continue in all cases until the end of the calendar month on which the termination becomes effective, irrespective of the Customer’s individual invoice date. There is no entitlement to continuation of the connection beyond the end of the calendar month, in particular until a specific day of the following month.

21. Termination of Options

Unless otherwise stipulated in the service descriptions for the respective option, options generally have a minimum term of one month. After expiry of the minimum term, options may be terminated subject to the notice periods specified in the respective service descriptions. Termination of a Service also includes all options associated with the terminated Service. Termination of an option does not affect the underlying Service. However, if a Service associated with an option is terminated before the minimum term of the option has been reached, the Customer shall owe the fees for the option until expiry of the minimum term; these fees shall become immediately due.

22. Termination for Important Reason

Twifi has the right to terminate the relevant contracts with the Customer or all or individual Services contained therein without notice if important reasons exist. An important reason exists in particular if:

  • the Customer fails to pay the required deposit on time;
  • there are indications that the Customer is using the Services for purposes contrary to the contract;
  • a judicial authority has legally ordered Twifi to cease providing the Service to the Customer;
  • the Customer’s use of Twifi’s or third-party networks is impaired;
  • there is reason to believe that the Customer provided incorrect or incomplete information when concluding the contract;
  • the Customer is in default of payment or performance after several reminders;
  • overriding public interests require it;
  • misuse within the meaning of Section 15 has occurred.

Reactivation of a terminated contract shall result in costs for the Customer.

The Customer has the right to terminate the relevant contract with Twifi without notice if an important reason exists. An important reason exists in particular if:

  • Twifi culpably commits a continuing material breach of contract and fails to remedy it despite receiving a reasonable warning from the Customer;
  • network availability at the Customer’s place of residence, place of work or business premises is unavailable for more than 7 days (except in cases of force majeure);
  • the Customer moves and the Service can no longer be used at the new place of residence;
  • the Customer dies.

23. Early Termination – Cost Consequences

Termination by the Customer before expiry of the minimum contract term or contractual term is only possible subject to cost consequences. In such a case, the Customer shall pay the total recurring monthly basic fees up to the end of the minimum contract term or contractual term; these fees shall become immediately due.

The Customer shall also pay the compensation if the contractual relationship is terminated by Twifi for an important reason for which the Customer is responsible (Section 22). If a Service is changed to a Service with a lower basic fee, Twifi may charge reasonable compensation.

24. Changes to Contractual Conditions

Twifi reserves the right to amend the contractual conditions at any time if justified interests of Twifi warrant such amendments. Changes shall be communicated to the Customer in an appropriate form and with reasonable advance notice. The Customer must accept changes to the contractual conditions for technical and operational reasons insofar as these are advantageous to the Customer or result only in a negligible reduction in Services without affecting essential provisions of the contractual relationship. Changes required as a result of statutory requirements (e.g. an increase in VAT or copyright levies) or judicial orders are also permitted.

If Twifi changes prices or Services in other cases and the total burden (price) for the Customer increases or individual Services are materially reduced, the Customer may terminate the contract or the relevant Services without cost as of the date the change takes effect, unless Twifi offers the Customer, within 14 days of receiving the termination notice, one of the following alternatives at its discretion: (i) continuation of the existing contractual conditions without change or (ii) compensation for the total burden arising from the change by appropriate means.

If the Customer does not terminate the contract by the end of the advance notice period, this shall be deemed acceptance of the change to the contractual conditions. The change or alternative offer shall then become part of the contract. If the change concerns an additional service or option, the right of termination shall apply exclusively to the additional service or option.

25. Intellectual Property Rights

Any intellectual property rights associated with Twifi Services or the provision or sale of end devices, in particular software, shall remain with Twifi or the respective rights holder. The Customer receives a non-transferable, time-limited and non-exclusive right to use such rights in accordance with the contract. No further rights are granted to the Customer.

26. Miscellaneous Agreements

Twifi may engage third parties in Switzerland or abroad at any time to fulfil the contract. To the extent permitted by law, the Customer waives the right to set off any claims against Twifi. Side agreements, amendments and additions to the GTC, Special Provisions or other contractual documents must be made in writing and signed to be valid. Handwritten amendments shall only be valid if both parties acknowledge them by separate signature. Section 24 remains reserved. The Customer may only transfer rights and obligations under this contract to third parties with Twifi’s written consent. Twifi may transfer the contract to third parties without the Customer’s consent.

27. Blank Media Levies

The Customer shall pay any retrospective blank media levies charged by Swiss collecting societies on devices from the date on which the relevant copyright tariff enters into force.

28. Place of Jurisdiction and Applicable Law

The contract shall be governed by Swiss law. For disputes with business customers, the exclusive place of jurisdiction shall be the registered office of amenity GmbH in Aarau. In disputes with consumers, the mandatory statutory places of jurisdiction shall apply; any advance waiver of the statutory consumer jurisdiction is excluded. Mandatory places of jurisdiction under federal law shall remain reserved in all cases.

Part B – Online Shop Ordering and Delivery Conditions

These Ordering and Delivery Conditions apply to all transactions concluded by customers in the twifi Online Shop. Unless otherwise provided in these Ordering and Delivery Conditions, the General Terms and Conditions (Part A) of Twifi and the other applicable contractual conditions of the individual Services and products shall apply.

B1. Ordering

The offer published by Twifi is non-binding. Only the Customer’s submission of an order constitutes a binding offer, which Twifi may accept. In the case of multiple orders, orders exceeding the permitted quantity, unvalidated delivery addresses or exhaustion of stock, Twifi may cancel the order.

B2. Prices

VAT is included in all prices. The prices published in the twifi Online Shop shall apply. Price changes are reserved. Payments of invoices made at a Swiss Post counter are subject to an additional CHF 3.00 charge added to the invoice amount; the Customer must adjust the payment amount accordingly.

B3. Delivery Costs

Shipping and packaging costs: CHF 0.00. Cash on delivery: CHF 0.00. In the event of an incorrect address, the automatic return will be charged at CHF 9.00 and reshipment at CHF 10.00. Devices purchased in connection with mobile subscriptions are delivered cash on delivery. The Customer must pay this amount to the postal worker (cash only) or at the post office (also by card) before the device is handed over.

B4. Products

If a product is unavailable at the time of ordering, the Customer shall be informed immediately. In this case, the Customer has the option to cancel the order; however, the cancellation must be made immediately. Twifi reserves the right to limit the quantities delivered for certain products, both per order and per period of time. Prepaid: A maximum of 5 SIM cards may be registered per customer. Mobile subscriptions: A maximum of 3 SIM cards may be registered per customer. Any additional orders may be rejected by Twifi.

B5. Customer’s Obligation

Before placing an order, the Customer is responsible for checking the required mobile network coverage on https://www.twifi.ch.

B6. Order Confirmation

Deliveries are only possible within Switzerland. All orders shall be confirmed by Twifi. In all other respects, the General Terms and Conditions (Part A) of Twifi shall apply.

B7. Use of Customer Email Addresses During the Ordering Process

Twifi may use email addresses entered during the ordering process for further processing, e.g. to remind the Customer to complete an order. The email address shall not be disclosed to third parties.

B8. Delivery

Products and Services shall be delivered using the Swiss Post standard service. Deliveries are limited to Switzerland and shall be made to the delivery address specified by the Customer in the order. Delivery shall take place during the normal delivery times of Swiss Post. If the Customer is not at home at the time of delivery, the Customer has seven days to collect the delivery from the post office. If the delivery address provided by the Customer is incorrect or cannot be located by Swiss Post, the Customer shall be charged CHF 9.00 for the automatic return and CHF 9.00 for the subsequent delivery.

B9. Identification

For deliveries of products and Services in combination with a Twifi product, the identity of the recipient shall be verified by the postal employee making the delivery. If the details do not match, the delivery may not be handed over. The Customer must therefore ensure that their personal data is recorded exactly as stated on the identification document. For natural persons residing or staying in Switzerland, the following identification documents are accepted: valid Swiss passport, valid Swiss identity card, B permit (residence permit), C permit (settlement permit), Ci permit (residence permit with gainful employment), G permit (cross-border commuter permit; Swiss address required) and L permit (short-term residence permit).

B10. Warranty Provisions

In the event of a device defect, customers may claim the manufacturer’s 12- or 24-month warranty for devices sold by Twifi, depending on the manufacturer. The warranty claim is subject to the conditions of the respective manufacturer. Subject to the repair warranty set out below, Twifi provides no further warranties for devices sold by Twifi. The Customer is obliged to inspect the device immediately after purchase and report any defects immediately.

B11. Third-Party Services

Twifi provides no warranty for products and services provided by third parties; their respective GTC shall apply.
